LIMITED WARRANTY ON RUSTICA PRODUCTS

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

THIS LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT OUR WEBSITE HTTP://RUSTICA.COM/WARRANTY-INFORMATION AND IN THE DOCUMENTATION WE PROVIDE WITH THE ORDER CONFIRMATION.

WE WARRANT THAT DURING THE APPLICABLE WARRANTY PERIOD, THE PRODUCT OR COMPONENT THEREOF WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

TO THE EXTENT NOT PROHIBITED BY LAW, THIS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY STATEMENT AND TO THE EXTENT NOT PROHIBITED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, WE LIMIT THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT OR STORE CREDIT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

WHO MAY USE THIS WARRANTY?

Ever Energy, Inc., DBA Rustica., located at 1060 Spring Creek Place, Springville, Utah 84663 (“we”), extends this limited warranty only to the customer who originally purchased the product (“you”). It does not extend to any subsequent owner or other transferee of the product.‌

WHAT IS THE PERIOD OF COVERAGE AND WHAT DOES THIS

LIMITED WARRANTY COVER?

This limited warranty starts on the date of your shipment and lasts for the applicable period set forth below (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. For the Warranty Period as defined below, this limited warranty covers defects in materials and workmanship of our products (each, a “product”).

Defects in material or workmanship. Note: Glass can be widely defined as an amorphous solid. An amorphous solid can be considered to have a random arrangement of atoms, such as observed in a gas. An irregularity in the clarity of glass is not necessarily a defect. In material.

30-day limited or until installation. Please do not install a product that you believe has a warranty issue.

Anything determined to be a result of the “nature” of glass as an amorphous solid.

Rustica can not be responsible for finishing, sealing and protecting a product that is requested unfinished or literally not complete.  The finishing, sealing and protecting the product, and therefore the results would be the responsibility of the company that finishes, seals and protects it.

 DEFINITIONS and CLARIFICATIONS

  • Warping, Bowing, or Twisting
    • “Warping,” “bowing,” or “twisting” is defined as a deviation in the plane of a door, mantle, or other applicable product exceeding 1/4 inch (1/4″) over an 8-foot (8′) length. Measurements shall be taken across the full surface of the product in accordance with standard industry practices. Please see the link.
    • If you believe your product is warped, bowed or twisted, please follow these instructions and submit the information with pictures:

  • Out of Square
    • “Out of square” refers to the condition in which the product’s corners or sides are not at true right angles. To determine squareness tolerance, measure the product diagonally from corner to corner in both directions. Add the two diagonal measurements together and divide by two to determine the average. A variance of up to 1/2 inch (1/2″) over an 8-foot (8′) length is considered acceptable within squareness tolerance.

  • Unfinished
    • Unfinished products are products that are not finished by Rustica. This includes selections of Raw Unfinished, Finish Ready and Primer White or any other selection that requests Rustica to not finish (actually complete the important final step of a finish and sealing coat) the product. These products are not covered by this limited warranty.
  • Small Imperfections
    • Small imperfections, when notified within the 30 days of shipment, will be addressed with a touch up kit. To be eligible for a replacement the defect in materials or workmanship needs to be visible in a photo from 6 feet away and not "addressable" by a touch up kit.
  • Missing Items
    • It is uncommon, but sometimes we have customers report that an item is missing. Based on the nature of the business and the fact that many orders get sent to job sites with multiple contractors and subcontractors, it has been our experience that sometimes items are reported missing that we show as shipped. We are very interested in your satisfaction as a customer so please let us know if something is missing. However, please understand that 60 days after reception we can no longer assume that a missing item was not shipped. We will do our best to verify that we show the item shipped and if that is the case you will need to repurchase the missing item.
  • Sufficient Overhang or Portico for Exterior Doors
    • Exterior doors must be appropriately protected from excessive exposure to the elements, temperature and moisture with a sufficient overhang or portico. Exterior products that are not covered by a sufficient overhang or portico are not covered under this limited warranty. For purposes of this limited warranty, “sufficient overhang” depends on the climate and direction the door faces and is calculated as follows
    • P = measured projection of the overhang
    • H = the height from the base of the door to the bottom of the overhang
    • W = the width of the overhang

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover and there is no liability responsibility for any costs associated with delays in manufacturing, installation or uninstallation costs, transportation or any other costs associated with the customer’s project.  

Please inspect your product carefully before installation. This limited warranty does not cover any costs associated with return shipping, installation or de-installation, including but not limited to contractor or installer time, travel, or transportation of the product for any reason.

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; (h) external causes such as accidents, abuse, or other actions or events beyond our reasonable control or improper installation.

This limited warranty does not cover products that are not installed within 30 days of receipt. Due to the nature of the product and the many possibilities that may occur out of the manufacturer's control this warranty does not cover products that are not installed within 30 days of receipt.

In addition, this limited warranty and the return policy does not apply to

  • Any unfinished product, including doors that are purchased “raw unfinished”, “finish ready”, or “primer white”
  • Do-it-Yourself and Cottage Barn Door Kits
  • Doors that are ordered as “unassembled” (even if we assemble them in our shop as a courtesy)
  • Wood products in Hickory (since the natural nature of Hickory is to split and crack)
  • Exterior doors ordered in Matt Black (due to the nature of black to attract heat)

Please note that wood products generally are susceptible to expanding and contracting due to temperature and moisture from rain and/or humidity based on location, exposure to the elements and environment. Note also that the natural state of steel is vulnerable to oxidation with exposure to rain and/or humidity. We provide a quality-built product, and we offer finishes with a warranty to protect the wood and metal, but except as expressly set forth above, this limited warranty does not cover changes in any products or finishes (including warping, separating, splitting, expanding, contracting, rust or fading) due to exposure. Interior doors and hardware are intended only for interior use, and this limited warranty does not cover changes to any interior products or finishes due to exterior use. You are responsible to understand this warranty and make sure that your application, location, and environment are conducive to wood and/or steel products. Products are not designed for exterior use unless they are expressly defined as “exterior” in the product specifications.

Finally, this limited warranty does not cover issues deemed by us to be natural blemishes and imperfections, “character” of the raw materials.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

With respect to any defective product during the Warranty Period, we will, in our sole discretion, either (a) repair or replace such product (or the defective part) free of charge or (b) provide store credit of the purchase price of the product towards the purchase price of another product. This warranty does not cover shipping, crate, or handling fees, either for your return of a defective product or for our return of the repaired or replacement product to you (if we elect to repair or replace the defective product).

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must call (800) 891-8312 or email our Customer Service Department at support@rustica.com during the Warranty Period to obtain a Case Number. If a product needs to be returned, a Return Authorization will be issued as well. No warranty service will be provided without a Case Number, and our service team will likely require detailed information and pictures of the issue from you.In order to process a warranty claim the following information may be needed. Due to the nature of product updates and revisions, including finishes and textures, if a product is replaced under warranty, it may be necessary to replace it with a similar or comparable product if an exact duplicate of the original product ordered is no longer available.

We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

LIMITATION OF LIABILITY 

MANUFACTURING & DELIVERY DELAYS

Rustica.com makes every effort to provide accurate estimated lead times for the manufacturing and delivery of its products. However, all stated production schedules, ship dates, and delivery timelines are estimates only and are not guaranteed.

By purchasing Rustica.com products, you acknowledge and agree that Rustica.com shall not be held liable for any damages, losses, claims, or expenses—whether direct, indirect, incidental, special, or consequential—arising from or relating to manufacturing delays, extended lead times, late product delivery, or any associated scheduling impacts.

This limitation applies regardless of cause, including but not limited to supply chain interruptions, material shortages, labor conditions, carrier delays, force majeure events, or other circumstances beyond Rustica.com’s control.

No warranty or guarantee, express or implied, covers delivery dates or lead times, and no liability will be assumed by Rustica.com for any inconvenience, additional costs, lost time, or lost business resulting from such delays.

ORDER ACCURACY

Rustica shall not be held responsible or liable for any errors, omissions, or miscommunications regarding a customer’s order, including but not limited to those arising from assistance, recommendations, or guidance provided by Rustica personnel through phone, email, chat, or any other form of communication. The Order Confirmation issued by Rustica constitutes the complete and final agreement between the customer and Rustica regarding the products, specifications, dimensions, finishes, and all other order details.

There is a  24 hour “grace period” that Rustica waits before beginning manufacturing after the order is placed.  Without any additional communication from the customer in the 24 hour grace period, the customer acknowledges that they have reviewed and verified all order details and that such Order Confirmation accurately represents their intended selections. Rustica will manufacture and fulfill the order strictly in accordance with the Order Confirmation.

Rustica shall not be liable for any losses, costs, expenses, or damages—whether direct, indirect, incidental, consequential, or otherwise—arising out of or related to discrepancies between the customer’s expectations and the information contained in the Order Confirmation.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US?

The following informal dispute resolution procedure is available to you if you believe that we have not performed our obligations under this limited warranty: You must visit our 100% Satisfaction Guarantee Feedback page at https://rustica.com/satisfaction-guarantee-feedback/ and submit the details of the situation, together with photos, after which we will respond with a proposal to address your concerns. You must use this informal procedure before pursuing any legal remedy in the courts.
